Terms & Conditions
§ 1. General Provisions
These Terms & Conditions, hereinafter referred to as the “Terms & Conditions”, define the rules for using the online store available at https://balaganpol.sbs/en/, hereinafter referred to as the “Store”.
The Store is operated by BALAGAN limited liability company (sp. z o.o.) with its registered office in Warsaw, ul. Stępińska 22/30, building 1A, unit no. 222, 00-739 Warsaw, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, under KRS number 0000782251, REGON 383124231, NIP 5213863874, with a share capital of PLN 5,000.00, hereinafter referred to as the “Administrator”.

Each person should read these Terms & Conditions before using the Store.
Purchases in the Store require the Customer to have an active and functional email account.
§ 2. Type and Scope of Activity of the Store
Through the Store, distance sales via the Internet are conducted for clothing and accessories.
The offered products are new and manufactured in Poland.
§ 2¹. Electronic Services
The Administrator provides the following electronic services:
Customer Account – enabling registration in the Store, login, saving and editing user data, viewing order history, and tracking order status;
Order Form – enabling placement of orders in the Store;
Newsletter – sending information about products, news, promotions, and offers of the Administrator to the email address provided by the user.
To use the services referred to above, the technical requirements specified in § 4 of the Terms & Conditions must be met.
It is prohibited for users to provide unlawful content.
The Customer Account service agreement is concluded upon successful registration and is concluded for an indefinite period.
The user may at any time delete their Customer Account by requesting its removal at: shop@balaganpol.sbs.
Use of the Order Form begins when the user starts filling it in and ends when the order is placed or the form is abandoned before submission.
Detailed rules for placing orders via the Order Form are set out in § 5.
The Newsletter service agreement is concluded upon confirmation of subscription and is free of charge and concluded for an indefinite period.
The user may unsubscribe at any time by clicking the unsubscribe link in any message or by contacting: shop@balaganpol.sbs.
§ 3. Information on Personal Data Processing
The controller of personal data of Customers within the meaning of Article 4(7) of Regulation (EU) 2016/679 (GDPR) is BALAGAN sp. z o.o. with its registered office in Warsaw, ul. Stępińska 22/30, building 1A, unit no. 222, 00-739 Warsaw, entered into the National Court Register under KRS 0000782251, REGON 383124231, NIP 5213863874, with a share capital of PLN 5,000.00.

§ 4. Technical Requirements
To use the Store, the following are required: an internet-enabled device, an up-to-date version of a commonly used web browser, an active email address, and enabled cookies and JavaScript.
§ 5. Rules for Placing Orders
Information provided on the Store’s website, including product descriptions, technical and functional parameters, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.
Before confirming a purchase, the Store provides the Customer with the following information:
detailed description of the product and its characteristics,
total price including taxes, delivery costs, and total order amount,
payment methods and deadlines,
method and time of performance of the contract.
Orders are placed via the form available in the Store after clicking “Order with obligation to pay” next to a product or in the cart summary. The Customer provides:
first and last name or company name,
email address,
phone number,
tax identification number (NIP),
delivery address.
The Customer places the order after reviewing the Terms & Conditions and the information indicated above, which is displayed electronically at the final stage before confirming the order. By clicking “Order with obligation to pay”, the Customer submits an offer to conclude a contract.
All prices are shown in PLN or another indicated currency and include VAT. The price shown in the cart summary includes delivery costs.
The Store is obliged to deliver goods in conformity with the contract.
An order is accepted for processing once the Store confirms its acceptance.
Confirmation is sent automatically after placing the order.
The Store may suspend order processing if there are doubts regarding the accuracy of the Customer’s data.
If some products are unavailable, the Customer will be informed and may decide whether to proceed partially or cancel the order.
The price valid at the time of order placement is binding.
Accepted payment methods include electronic payments (Przelewy24, PayPal, PayPo, Klarna, payment card) and bank transfer.
Payment must be made within 3 days of order confirmation.
The contract is concluded upon payment after order acceptance.
Products are shipped within 7 business days after payment is received.
Deliveries are made via DHL, DPD, Polish Post, or InPost parcel lockers. Shipping costs are specified in the Shipping section.
Multiple items are shipped together unless otherwise specified.
Risk transfers to the Customer upon delivery to the carrier (if selected by the Store).
Along with the product, the Store provides withdrawal forms and information forms as attachments.
An invoice is sent electronically. The Customer must provide correct billing details.
Customers may receive transactional emails and marketing communications only with consent.
§ 6. Complaints (Goods)
This section applies to consumers and certain individual entrepreneurs.
The Store is liable for lack of conformity of goods for 2 years from delivery.
If goods are non-compliant, the Customer may request repair or replacement.
The Store may refuse if the chosen remedy is impossible or excessively costly.
Repair or replacement must be carried out within a reasonable time and without significant inconvenience.
The Store covers all costs.
The Customer must make goods available for collection.
If repair/replacement fails, the Customer may request price reduction or contract termination.
Refunds are issued within 14 days using the same payment method.
Complaints may be submitted by email: shop@balaganpol.sbs or by post to the indicated logistics address.
A complaint response is provided within 14 days.
§ 6¹. Complaints Regarding Electronic Services
Complaints may be submitted by email or by post.
Recommended information includes name, contact details, description, and request.
The Administrator responds within 14 days.
§ 7. Right of Withdrawal
Consumers may withdraw from the contract within 14 days without giving any reason.
The period starts from receipt of goods.
Withdrawal is not available in cases specified by law (e.g. custom-made goods, sealed hygiene products after opening, fully performed services with consent, etc.).
Goods must be returned to the indicated address within 14 days.
Return shipping costs are borne by the Customer.
Refunds are made within 14 days, including delivery costs (except additional costs for non-standard delivery).
Refunds may be withheld until goods are received.
§ 8. Final Provisions & Out-of-Court Dispute Resolution
These Terms do not limit consumer rights under mandatory law.
Polish law applies.
Consumers may use alternative dispute resolution mechanisms via consumer ombudsmen, trade inspection authorities, and organizations such as the Polish Consumer Federation.
§ 9. Other Provisions
All content in the Store is protected by copyright.
Use is allowed only for personal use.
Copying, distribution, or commercial use is prohibited.
The Administrator may amend the Terms & Conditions.
Changes to electronic services require prior notice. Users may terminate services if they do not accept changes.
